Listed here are the Terms & Conditions of Sale applicable to on-line purchases from Victoria Station Corporation Pty Ltd’s online Ordering system ("Victoria Station"). These terms and the laws of Victoria, Australia, apply to all transactions for the purchase of Victoria Station products ("Products") from Victoria Station through its web Site at www.victoriastation.com.au and any associated web pages or sub-Sites (the "Site"). Victoria Station does not offer or agree to any conditions, warranties, guarantees or representations relating to the quality, description or performance characteristics of the Products other than those set out in these terms. By visiting the Site the Customer accepts the terms and conditions of use relating to this Site. The Customer’s completion of the Checkout form on this Site will constitute an offer to the Customer to purchase Products (the "Order"). All Orders are subject to acceptance by Victoria Station The prices to be paid by the Customer for all Products will be Victoria Station’s current selling price on the date of receipt by Victoria Station of the Order, less any applicable discounts in effect at that time. Orders can attract a delivery charge as set out on the Delivery Charges page of the Checkout. Victoria Station will notify a Customer in the event of a pricing error on the Site before an Order is delivered. And the Customer will have the opportunity to cancel their Order within a reasonable time. Victoria Station will not be responsible for errors in pricing that appear on the Site Victoria Station reserves the right to change its prices from time to time without prior notice to the Customer. All prices on this Site include Australian Goods and Services Tax (GST). The GST payable by the Customer will be shown on invoice. If there are delivery charges to the nominated address, this will be advised to the Customer on the delivery screen and Order confirmation pages of the Site. In the unlikely event that a Product is "out of stock" when Victoria Station processes an Order, Victoria Station will contact the Customer to discuss revised delivery times or refund options All Orders by the Customer under this Agreement must be placed via the fields provided on this Site and must specify the information requested, including (but without limitation):
The Customer must complete all information requested in the fields provided before the Order is processed by Victoria Station Victoria Station will not accept Orders if the Customer does not offer to pay by one of the credit cards or payment methods listed in this Site or if the Customers credit card provider does not confirm the payment or if the Customers credit account is on stop credit or has no available credit Victoria Station will send the Customer an e-mail acknowledging the Products Ordered as soon as possible after the Customer places an Order. If Victoria Station does not accept the Customers Order for any reason, it will inform the Customer by email in the same manner Payment for Products purchased from Victoria Station via the Site can be made by VISA MasterCard, Diners Club, American Express credit cards, direct deposit via EFT (electronic funds transfer), cheque, Australia post money Order or Paypal. Victoria Station will verify the credit card or credit account information submitted by the Customer and will advise the Customer that its Order has been accepted. The Customer agrees to submit to Victoria Station such information as may be reasonably requested by Victoria Station for the authorisation and verification of its credit card purchases If the Customers entire Order is cancelled prior to shipment Victoria Station will apply a credit to the Customers credit card whichever is applicable and may also apply a cancellation fee at its discretion. If an Order has already shipped Victoria Station’s normal returns and exchanges procedure will apply Victoria Station will arrange delivery of all Products to the Customer using its nominated freight carriers. A Customer must not arrange its own courier to collect the Products from Victoria Station. Risk in the goods passes to the Customer upon delivery to the Customer. No Products will be accepted for return without a Return Authorisation (RA) Number. A full credit/refund will be allowed on Products returned within 7 days of invoice. Product returned after 7 days and up to 30 days after invoice will still be eligible for a full refund/credit however we reserve the right to incur a handling charge of 10% of the selling price at our discretion. A reimbursement will not be allowed on Product returned after 30 days from invoice. Product returned for refund/credit must be freight paid to Victoria Station head office once authorised by a Victoria Station Returns officer at time of requesting the return, and invoice number, date and reason for return supplied. If due to a warehouse or other error on the part of Victoria Station, the Customer receives a Product which does not correspond or quadrate to its Order, the Customer must contact Victoria Station within 7 days of receipt of the Product and may purchase a replacement Product from the Site, after returning the original Product to Victoria Station, provided that the returned Product is in new condition with its original packaging unopened. Victoria Station may revise these terms and conditions from time to time. Customers should therefore periodically visit this page to view any such revisions Victoria Station Products have a 12 month return to manufacturer warranty (unless otherwise specified). Subject to the conditions below, Products are expressly warranted by Victoria Station against defects in materials and workmanship for a period of 12 months (unless otherwise specified) from the date of the original sale recorded on this Site. Claims for items of luggage that are damaged by improper handling by airlines/airports or other facilities/persons involved in the handling of baggage, or damaged due to fair wear and tear, negligence, damage in transit, alteration or misuse will not fall within the scope of our warranty. The definition of normal wear and tear is best described as normal wear and tear that will occur when an item is used for its intended purpose. (For example, a leather handbag will eventually show signs of wear on the leather, and the zips will eventually wear out) Included in this definition we consider minor and major cuts, scratches, dents, or soiling to be normal wear and tear.
Furthermore, loss or damage to parts protruding from the item such as wheels, feet, pull-handles, straps, flaps, etc can occur after extensive use and are not covered under warranty. Damage resulting from over-sized or over-packed bags is also not covered in the warranty. Defective workmanship on the other hand cover materials and workmanship, so if a material on the item fails, or an item is badly made or finished off for example, then it would be deemed to have defective workmanship. This however needs to be assessed on a case by case basis. It is important to note is that our products are warranted for their intended use i.e the goods must reasonably conform to an ordinary buyer's expectations, i.e., they are what they say they are. For example a customer using a suitcase to transport reams of paper, will not meet the warranty test because the suitcase in this example was never meant to carry this kind of weight load. The warranty is in addition to other warranties expressed or implied under the Trade Practices Act (1974). The warranty applies to all products sold by Victoria Station and applies only to the original purchase from this Site. Victoria Station will not accept or have any other responsibility or liability whatsoever for or in relation to the Product including liability for negligence or liability for incidental, consequential, indirect or special damages, including without limitation, loss of actual or anticipated revenue or loss of data or for date being rendered inaccurate INDEMNIFICATION AND LIMITATION OF LIABILITY The internet by its nature is not reliable. Consequently the Customer accepts that this Site is offered “as is” and “as available” basis. Victoria Station takes all necessary measures to ensure the Site is functioning at all times, Victoria Station does not warrant that the Site will be secure, error free, uninterrupted, or that defects will be rectified. Every endeavour is made to ensure our servers remain free of viruses, spyware, bugs or other defects The goods and services provided by Victoria Station will be rendered with due care and skill to the extent required by Division 2 of the Trade Practices Act 1974 and applicable similar State legislation Apart from the statutory liability referred to above, Victoria Station will not under any circumstances be liable or responsible for any damage or loss, whether arising in tort, contract, bailment, or howsoever otherwise; and all loss or harm suffered is at the risk of persons entering on this site. Furthermore, you agree to indemnify Victoria Station against any loss or damage it may suffer arising out of your negligence or breach of these conditions. In these conditions "Victoria Station" means Victoria Station Pty Ltd, ABN 20 116 780 644 and its assigns, and includes its employees and contractors Victoria Station Corporation Pty Ltd owns the intellectual property rights to all content on this Site, including design, coding, structure and style. Unless otherwise stated copyright laws protect the contents of this Site. The trademarks appearing on this Site are primarily trademarks of Victoria Station and/or its associates. Other trademarks displayed on the Site are trademarks of the respective owners. Nothing contained on this Site should be construed as granting any license or right of use of any trademark displayed on the Site without the express written permission of Victoria Station or the relevant associate, or the respective third party owner, and any such use is strictly prohibited. The contents of the Site may not be reproduced, distributed, transmitted, displayed, published or broadcast without prior written permission from Victoria Station Corporation Pty Ltd. Content of this Site is not to be used for commercial purposes. You agree that you will not hack into the Site nor employ any robot, spider or other device or process to use the Site for any unauthorized purposes.
